AS SEEN ON
If you are involved in a road traffic accident with an uninsured or untraced (hit and run) driver you could claim compensation via the Motor Insurers’ Bureau (MIB). This is an organisation funded through insurance companies via a levy on all vehicle insurance policies. The MIB steps in for cases either where the driver at fault can not be traced, or where they do not have a valid insurance policy in place. Their role is to pay compensation to any victims and maintain the motor insurance database, recording insured vehicles. Our team could help with untraced and uninsured driver claims.
Whilst uninsured driver claims can be more complicated, the absence of insurance cover does not prevent you seeking compensation. To claim compensation you must report the accident to the police, will need to collect evidence, and could benefit from the help of a specialist personal injury solicitor.

What Are Uninsured Driver Claims?
Uninsured driver claims are a way for those harmed in accidents where the driver at fault does not have a valid motor insurance policy in place to seek compensation. Typically, these claims are facilitated by the Motor Insurers’ Bureau, with compensation being awarded for injuries and well as out-of-pocket expenses. Uninsured driver claims act as a safety net, ensuring that those injured in this type of accident still have a route to claim compensation.

Can I Claim After An Accident With An Uninsured Driver?
Yes, you can claim compensation for your injuries and financial losses after an accident with an uninsured driver. To do so, you must show that your case satisfies three key points.
1. The Other Driver Had A Duty Of Care
All motorists, drivers, and others using the roads in the UK must adhere to the Highway Code and the Road Traffic Act 1988. Per this, they must use the roads in a way which does not place themselves or others in danger.
2. The Uninsured Driver Caused An Accident
In addition to driving without insurance, the other party must be shown to have caused an accident. This may be by failing to stop at a pedestrian crossing and hitting someone, failing to give way at a junction and colliding with a stopped car, a collision when speeding, or otherwise not driving with due care and attention.
3. The Breach Caused Your Injuries
You must have suffered physical and/or psychological injuries in order to receive compensation. Injuries can range from the minor through to the serious.
An advisor could assess whether your case meets these criteria. If it does, they could connect you to one of JF Law’s specialist solicitors.
Uninsured Driver Claims Examples
Examples of accidents caused by uninsured drivers could include those caused by failing to pay due care and attention, not stopping at a pedestrian crossing, or striking a cyclist when changing lanes.
Circumstances in which you could claim compensation may include,
- A driver speeding on a high street. They fail to observe a pedestrian stepping on to a zebra crossing. The driver fails to stop in time, striking the pedestrian, causing them head injuries.
- A driver fails to slow down when approaching a give way sign at a junction, they do not check for approaching cars and strike a passing vehicle. The driver of this vehicle is hit side on, suffering neck and shoulder injuries.
- A driver does not check their mirrors when changing lanes on a dual carriageway. They cross into the path of an oncoming motorcyclist, knocking them off their bike. The motorcyclist suffers extensive injuries across one side of their body.

How Much Compensation Is Awarded For Uninsured Driver Accidents?
How much compensation is awarded for accidents involving uninsured drivers may be based on the type of injury sustained and whether you also experienced any financial losses. Compensation settlements can be made up of two parts, general damages and special damages.
General damages are awarded for physical and psychological injuries and may be valued using the Judicial College Guidelines (JCG). The JCG is a resource used by legal professionals and courts in determining how much an injury may be worth.
We take figures from the JCG to populate rows 2 – 8 of the following table. The figure in the first row is an illustrative example of what could be awarded where special damages are taken into consideration. Those in the final 2 rows are taken from the fixed tariff awarded in cases of whiplash injuries. This tariff is taken from the Whiplash Injury Regulations 2021.
| Injury | Notes | Damages |
|---|---|---|
| Multiple injuries + special damages for medical bills, care costs, and lost income. | Severe injuries. | Up to £1,000,000+ with special damages. |
| Paralysis – tetraplegia. | Cases may also involve head and brain injuries. | £396,140 to £493,000. |

Will The MIB Cover Out For Financial Losses?
The MIB will cover financial losses, such as medical bills, associated with uninsured driver claims. These losses are assessed under the second part of a settlement, special damages. Financial losses the MIB may cover include,
- Medical expenses.
- The cost of domestic care and support.
- Lost income and earnings.
- Travel costs (getting to and from medical appointments).
The MIB will need to see evidence of these losses in order for them to be included in your claim. You may use bank statements and invoices as verification.
Please contact our team for an assessment of what you may be eligible to claim in compensation.
What Is The Uninsured Driver Claims Process?
The uninsured driver claims process involves reporting the road traffic accident to the police (and your own insurer, when relevant), collecting evidence, and filing a claim through the Motor Insurers’ Bureau.
Steps you can take:
1. Get Medical Treatment
Following a car accident, you may need to call for paramedics, visit a hospital, or visit your GP. This prioritises your health, gets the care you need, and creates official medical records detailing your injuries.
2. Report The Accident
Road traffic accidents in which someone was injured must be reported to the police within 24 hours of the collision. When you do so, you can ask the police for a crime reference number. Accidents may also be reported to your own insurance company.
3. Gather Evidence
You need evidence of what happened, which can be submitted to the MIB including,
- Police reports and crime reference numbers.
- Dashcam/ CCTV footage.
- Photos of the scene of the accident, damage to vehicles, and of visible injuries.
- Witness contact details.
- Medical evidence.
4. Keep An Injury Diary
Keep a simple record of how your injury is affecting you. You can record,
- Day-to-day symptoms.
- Pain levels.
- Medical appointments and treatments.
- Out-of-pocket expenses.
5. Talk To A Solicitor
Consulting with a specialist solicitor as early as possible can help you to understand your legal options. A solicitor could confirm whether your case falls within the scope of the Uninsured Drivers Agreement and whether you could pursue a claim via the MIB.
6. Claim Within The Time Limit
The limitation period in which most claims must be started is 3 years from the date of the accident. This is set by the Limitation Act 1980. However, there are circumstances in which the time limit may differ.
