Your employer owes you a duty of care under the Health and Safety at Work etc Act 1974 (HASAWA). Therefore, they need to take reasonable steps to protect your health and safety when you are at work. This is regulated by the Health and Safety Executive (HSE). You may be eligible to start an accident at work claim if:

The Occupier’s Liability Act 1957 (OLA) states that an occupier must take the necessary steps that will ensure your reasonable safety. Time Limits For Making A Claim

Under the Limitation Act 1980, the general time limit for personal injury claims is three years from the date of injury. However, there may be exceptions in cases where the injured person is:

  • Lacking the mental capacity to make decisions for a claim
  • Under the age of eighteen

In these cases, the time limit is paused. It will only start if the injured party:

  • Regains capacity. 
  • Turns 18.
