We need to establish that a duty of care was owed at the time of injury for a whiplash claim to be valid.
Road users owe a duty of care to each other. They must navigate in a safe and responsible manner. Rules under the Road Traffic Act 1988 and parts of the Highway Code are that road users, including individual drivers, public transport drivers, motorbike riders, cyclists, pedestrians, horse riders, and people riding e-scooters and/or disability scooters navigate safely.
To make a whiplash claim, we need to know:

Whiplash Reform Programme
Your whiplash claim may need to be made through the Whiplash Reform Programme. However, there are certain requirements that you will need to meet in addition to the personal injury claims criteria discussed above. The following apply to claim through the Reform Programme:
- The accident occurred in England or Wales on or after the 31st May 2021.
- You sustained injuries as a driver or passenger in a vehicle.
- You are at least 18 years old.
- The overall value of your injuries does not exceed £5,000.
Furthermore, whiplash injuries are valued in accordance with the tariff set out in the Whiplash Injury Regulations 2021. However, if you suffered injuries that are not in this tariff, they will be valued in another manner. Additionally, if your injuries exceed the £5,000 limit, your claim will be made in the traditional manner, but the tariff amounts could still apply.

How Much Compensation Can I Claim For Whiplash?
As no two cases are the same, it is difficult to say how much compensation you could claim for a whiplash injury. In May 2021, the government introduced The Whiplash Injury Regulations 2021, which meant that whiplash claims would be valued using a tariff, as we discussed above. Can I Make A Whiplash Claim As A Passenger?
If your whiplash injury happens as a result of a road traffic accident, you might think that the driver is the only person who can make a claim. However, if you have a passenger with you and they have injuries as well, then the passenger can also make a claim for compensation. Please note, that these are separate personal injury claims, even if you are claiming on behalf of another party.
There are alternative circumstances when you can make a claim on behalf of the passenger if the passenger is a minor (your child). The Evidence You’ll Need
To make a successful claim, it is important to gather evidence. Examples of evidence include:
- CCTV footage.
- Police incident report – you can make a road traffic incident report.
- Contact details of the third-party insurance company.
- Photographs of the damage to the vehicle and the location.
- Sketch of the direction you were going and the third party was going.
- Witness details – contact information from witnesses to the accident if they can provide a statement later on.
- Medical evidence – a medical report will be used to determine the severity of your injuries.
Time Limits - How Long You Have To Claim
Under the Limitation Act 1980, there is a 3-year time limit for making a whiplash claim.
However, there are some exceptions to the rule:
- If the injured party is under 18 (a minor), a parent, friend, family member, or even a solicitor can apply to become a litigation friend on their behalf. However, if they turn 18 and a whiplash claim was not made, then the time limit starts.
Another exception is:
- If the injured party lacks the mental capacity to bring forward the claim. However, if they regain their mental capacity while the claim is ongoing, they may choose to continue with the claim themselves. If a claim was not made for them and they regain this capacity, then the time limit starts from the date it was deemed they made this recovery.
No Win No Fee Claims
