What Is The Whiplash Tariff?
The whiplash tariff is a system that compensates individuals who meet certain criteria set out by the Whiplash Injury Regulations 2021. This fixed tariff was introduced as part of the Whiplash Reform Programme, which affected how some road traffic accident claims in England and Wales were made. These reforms specifically changed how people claim for whiplash injuries in situations where:
- A claimant is over the age of 18
- Was a passenger or driver at the time of the incident
- Suffered total damages with a value of £5,000 or less

Established as a not-for-profit organisation in 1946, the Motor Insurers’ Bureau compensates individuals who have been in accidents caused by untraced or uninsured drivers. Besides paying out compensation for successful claims, the organisation maintains a database of all insured drivers in the UK. How Can I Make A Claim With The MIB?

Is There A Time Limit For Starting MIB Claims?
Yes, there’s a 3-year time limit for starting MIB claims from the date of the accident, as per the Limitation Act 1980. However, the following exceptions apply for 2 categories that cannot independently make their own claims:
- If the claimant is a child, the 3-year limitation period (as time limits are also known) does not begin until their 18th birthday
- If the claimant lacks mental capacity, the time limit will be paused indefinitely. Should they regain mental capacity, the 3-year time limit will begin from the date of recovery
