You may be eligible to start a taxi accident compensation claim if you meet the following criteria:

  • The defendant owed you a duty of care
  • The defendant breached their duty of care
  • This caused your taxi accident injuries 

All road users, including taxi drivers, owe a duty of care to anybody else who uses the roads. Therefore, they are legally obliged to adhere to the provisions of the Road Traffic Act 1988 and the Highway Code to use the roads safely to avoid harming others. Third-Party At Fault For A Collision With The Taxi

What Taxi Accident Or Injury Payouts Could Be Awarded?

The taxi accident compensation payout you may be awarded depends on the injuries you sustained and any financial losses you incurred.

Your injury compensation is calculated under the head of claim general damages. This figure is calculated by your solicitor, who reviews the independent medical assessor’s report of your injuries and compensation guidelines created by the Judicial College (JCG). 

The JCG is a list of injuries and their suggestive compensation brackets. The table below contains examples from this, except for the top figure, to show you how much you may be awarded. However, such figures are not guaranteed; they should only be used for guidance.

Determining The Final Taxi Accident Compensation Amount

If you incurred financial losses due to your taxi accident injuries, these may be considered in your overall compensation amount under the head of claim special damages. Some examples of the losses you may be compensated for include:

  • Lost wages and work benefits if you had time off 
  • Costs for private medical treatment or mental health services

Taxi Whiplash Injuries

The law regarding whiplash injury claims has recently changed with the introduction of the Whiplash Reform Programme. Although you still may claim compensation for such injuries, it is now valued against a tariff laid out within the Whiplash Injury Regulations 2021. The table below contains examples from this. 

Furthermore, you might need to claim through the Whiplash Reforms if:

  • You were a passenger or driver in a motor vehicle. 
  • The accident occurred in England or Wales. 
  • You were aged 18 or older at the time of the accident. 
  • The injuries you suffered do not exceed £5,000, even if the injuries you sustained are not listed in this tariff. If that is the case, they will be valued using the JCG above but your claim will still be made through the Reforms.

What Evidence Will I Need For A Taxi Accident Claim?

How Long Will I Have To Claim For A Taxi Accident?

As with all personal injury claims under the Limitation Act 1980, you will have 3 years to start a taxi accident claim. This typically begins on the date you sustained your injuries, so please make a note of this. 

However, some adjustments may be made to this rule depending on the circumstances of the claimant. For example, the time limit may be paused if:

  • The claimant is a child. In such claims, the time limit will begin on their 18th birthday and end on their 21st birthday. 
  • The claimant has no mental capacity. Here, the time limit is indefinitely frozen unless they regain cognitive ability.

These types of claimants cannot make taxi accident claims themselves. 

If the time limit on a taxi accident claim is paused, a litigation friend may start the process for the claimant. Anyone above the age of 18 may do this if they act in the claimant’s best interests.
