Can I Claim Compensation For Being Stabbed?

The CICA is an executive agency funded by the Ministry of Justice established to give the victims of violent crimes a means of claiming compensation. This is done by making a criminal injury claim.

In order to claim compensation for being stabbed through the CICA, you will need to show the following:

  1. You were the victim of a violent crime as defined within the Criminal Injuries Compensation Scheme 2012.
  2. That crime occurred in Great Britain (England, Scotland or Wales) or another relevant place. 
  3. The crime was reported to the police.
  4. Your claim is started within the time limit (this is generally 2 years).

How Do I Claim Compensation For A Stabbing?

In order to make a criminal injury claim through the CICA, you will need to provide certain evidence. This is:

  • Your crime reference number. This is why it is vital the crime be reported to the police.
  • Proof you meet the residency requirements.
  • Medical evidence highlighting what injuries you sustained.

You will not need to prove the crime occurred. The CICA will liaise with the police for any additional evidence they may need for your claim.

Can I Claim On Behalf Of A Loved One For Fatal Stab Injuries?

The Scheme makes provision for certain qualifying relatives to claim compensation for the victim’s death. What this means is you could receive a bereavement payment, a dependency payment or a child’s payment where applicable.

Qualifying relatives include:

  • The spouse or civil partner of the deceased.
  • A partner who lived in the same household continuously for two years prior to their death.
  • A spouse or partner of the deceased who could not live with them due to health issues.
  • A child or parent.
  • A spouse or civil partner, or former partner who was financially dependent on them.

How Long Will It Take To Receive Compensation For Being Stabbed?

The CICA cannot state how long it will take to assess your application, as this is dependent on obtaining and considering all applicable evidence to decide if you are entitled to any compensation and how much.

However, they do state that they aim to assess the majority of applications within 12 months. More complex cases could take longer to finalise. This is to ensure that the compensation you receive reflects the severity of your injuries and their long-term impacts.

How Much Compensation For Being Stabbed?

Compensation for being stabbed in a successful criminal injury claim is paid out in accordance with the fixed tariff amounts from The Scheme. What this means is, that given injuries will receive a specified compensation sum. We have provided a few examples from the tariff here.

Where more than one injury has been sustained, compensation will be awarded in accordance with the multiple injuries formula. This means:

  • The highest value injury will receive 100% of the tariff amount.
  • The second highest value injury will receive 30% of the tariff amount.
  • Finally, the third highest value injury is compensated at 15%.

While the CICA do not award compensation for more than 3 injuries, a separate tariff not affected by the formula is used in cases of pregnancy, loss of a foetus or the contraction of an STI as a result of the violent crime.

What Financial Losses Can I Claim For After A Criminal Injury?

As part of your compensation for being stabbed, you could also receive special expenses. This includes:

  • Any physical aids damaged in the incident.
  • Any equipment needed to cope with the injuries suffered.
  • Any home adaptations needed to cope with the injuries.

To be able to receive special expenses, you need to prove that they were directly caused by your injuries. They also cannot be available for free elsewhere and must be necessary and reasonable.

You could also receive a loss of earnings payment if you meet certain eligibility criteria.

Can I Make A No Win No Fee Claim For Stabbing Injuries?
