How To Make Airport Accident Claims

Airport accidents could occur in various parts of an airport, such as the arrival and departure lounges, shops, and restaurants. You could claim for an accident in an airport if you suffered an injury due to the airport’s negligent actions.  An expert solicitor from our panel could help you throughout the airport accident claims process.

Key Takeaways

  • Airport accident claims could be made for injuries caused by incidents, such as slips and falls, faulty equipment, and airport transport accidents
  • Examples of injuries that could be suffered in an airport include fractures, soft tissue injuries and head injuries.
  • Airports can help prevent accidents by conducting regular risk assessments, signposting or removing hazards, and ensuring all staff have received health and safety training.
  • You may be able to claim for an injury suffered in an airport abroad, but you may be subject to their laws when claiming.
  • One of our solicitors could help you make a public liability claim on a No Win No Fee basis.

Please get in contact with JF Law to discuss your airport injury claim and receive free advice.

Can I Claim For An Accident In An Airport?

Yes, you could claim for an accident in an airport if said airport acted negligently, causing you to suffer an injury. As an occupier (a space accessible to the public), airports have a legal duty of care to ensure the reasonable safety of visitors, as set out within the Occupiers’ Liability Act 1957 (OLA). Essentially, to have a valid claim, you would need to prove:

  1. The airport owed you a duty of care
  2. They breached their duty of care. For example, they failed to repair broken stairs or cordon them off.
  3. The breach caused you to be injured. In the above example, you may fall down the stairs, suffering a broken bone.

What If I Was Injured In One Of The Airport Stores?

If you were injured in one of the airport stores, restaurants, or the premises of other service providers, you may still be able to claim. All of these stores owe the same duty of care under OLA. Therefore, if you suffered an injury in one of them due to their negligent actions or inactions, they could be deemed liable.

Please contact us for further information on who airport accident claims could be brought against.

What If I Was Injured In An Airport Whilst Abroad?

If you were injured in an airport whilst abroad, you may still be able to claim compensation. However, any such claim would be brought under the legal system of the country in which the airport is located. This may mean that time limits, eligibility criteria, and compensation amounts differ from those applicable to airport injury claims made in the UK.

To see if we could help you with making an airport injury claim abroad, you can contact our advisory team.

What Are Some Examples Of Airport Accident Claims?

Examples of airport accident claims include slips and falls on walkways, incidents in escalators and lifts, and accidents in the airport waiting lounges. Below, we explain some further examples in more depth:

  • Lift or escalator accidents. A lift door with a known fault that had not been repaired may close on your hand, crushing your fingers.
  • Slips, trips, and falls. A spillage in the airport waiting lounge was not signposted or cleaned in a timely manner, causing you to slip and suffer an ankle and back injury in the fall.
  • Faulty equipment. There are known faulty chairs in the waiting area of an airport, but they have failed to replace them or signpost that they are faulty. When you sit in the chair, it breaks, and you suffer a severe hip injury.

These are some circumstances in which airport injury claims may be made. Claims may also be made for in-flight injuries. Please contact us for further help and advice.

What Compensation Can I Get For Airport Accident Claims?

You could get compensation for physical and psychological injuries and the financial losses they caused in a successful airport accident claim.

Compensation can be awarded under 2 heads of loss. These are:

  • General damages – compensation for the pain and suffering of the injuries
  • Special damages – compensation for financial losses related to your injury.

Legal professionals may use medical evidence and figures published in the Judicial College Guidelines (JCG) when calculating your general damages. The JCG contains various injuries alongside guideline compensation brackets for each based on severity.

With the exception of the first row, we have taken figures from the JCG to create the following table.

How Can I Prove Fault For An Airport Accident?

You can prove fault for an airport accident using incident reports, medical records, and photos or video footage. Collecting this evidence can help to strengthen your case. Following an accident at an airport, you can:

Get Medical Help

Your first step should always be to get medical treatment for your injuries. You may need to visit,

  • A hospital A&E department.
  • A walk-in centre.
  • Your GP practice.

Not only does this protect your health and well-being, but it also creates evidence, such as your medical records.

Report The Accident

Having sought medical help, you should ensure that the airport accident and your injuries were reported to the relevant party. The accident may be reported to

  • The airport operator – if it occurred in a public space in the airport.
  • The retailer/ service provider – if it occurred in a shop, restaurant, or business operating at the airport.

Formal incident reports may strengthen airport accident claims.

Collect Evidence

You should collect as much evidence proving what happened, how you were harmed, and who was at fault as possible. Evidence can include,

  • CCTV footage of the accident
  • Financial records, such as payslips and invoices, to prove special damages
  • Witness contact information.

To learn more about the other types of evidence you could claim, you can read our dedicated guide on evidence for personal injury claims.

Keep An Injury Diary

Your diary can record:

  • Daily symptoms and pain levels.
  • Attendance of medical appointments.
  • The impact on daily activities.
  • How your income and earnings were affected.

Keeping an injury diary can help you, a solicitor if you choose to work with one, and other parties to the claim, see the overall impact of your airport injury.

Is There A Time Limit To Claiming For An Airport Injury?

Yes, there is a time limit when claiming for an airport injury, which is 3 years running from the accident date. This time limit is set out within the Limitation Act 1980.

Exceptions apply for those who were injured as minors or who lack the mental capacity to manage their own case. You can learn more about these in our guide on the personal injury limitation period.

Contact our advisors today to see if you are still within the time limit or if you have any questions about the airport accident claims process.
