What Are Ectopic Pregnancies?

An ectopic pregnancy is when the fertilised egg implants itself on the outside of the womb. This is usually inside a fallopian tube. These are the tubes which connects the ovaries to the womb.

NHS records show that 1 in 90 pregnancies in the UK are ectopic, which works out at approximately 11,000 per year.

If you have a misdiagnosed ectopic pregnancy, call today to speak with one of our advisors.

Signs And Symptoms

There are not always symptoms that your pregnancy is ectopic. However, the noticeable symptoms are:

  • Stomach/tummy pain. This is usually low down on one side that may be sudden, or develop gradually.
  • Vaginal bleeding
  • Shoulder tip pain (this is where the shoulder ends and arm begins).
  • Discomfort when using the toilet.

If the ectopic pregnancy grows large enough to split the fallopian tube (rupture), symptoms may include:

  • Sudden, sharp tummy pain.
  • Dizziness or fainting.
  • Feeling sick.

Can I Claim Compensation For My Misdiagnosed Ectopic Pregnancy?

In order to make a claim for compensation there are certain criteria that need to be met. You will need to prove that medical negligence occurred.

Part of this involves establishing whether a duty of care was owed. All medical professionals owe a duty of care to their patients that any care and treatment should meet a certain standard. It is only when this is breached and avoidable harm occurs that you might have good grounds to seek misdiagnosed ectopic pregnancy compensation.

Therefore, to prove medical negligence, we need to establish:

  • Did the medical professional owe a duty of care?
  • Was the duty of care breached by failing to provide the standard of care expected?
  • Did you suffer harm and/or injury that would have otherwise been avoided as a result of this breach?

If you meet these three criteria, speak to a member of our advisory team.

How Much Could I Claim?

It is difficult to confirm the amount of compensation that you could receive for a misdiagnosed ectopic pregnancy negligence claim, as this would depend on the severity of your injury and/or harm caused, as well as any financial impact.

There are both general damages and special damages that could form a settlement for a successful claim.

General damages compensate for your pain and suffering, including any mental harm suffered. Whilst special damages reimburse you for the financial impact.

The details of your injury and/or harm will be confirmed by an independent medical professional who will, in turn, provide a medical report which will have a prognosis period (how long it will take for you to recover) and confirm if you require any other treatments and/or assessments.

Those responsible for valuing your general damages will use your medical report and a document such as the Judicial College Guidelines (JCG) to value your claim. These guidelines provide suggestive compensation values for all types of injuries.

Below are some examples of the amounts for general damages that could be awarded. Please note that the first insert in the table is not taken from the JCG.

However, to recover your special damages, you will need to prove these costs.

The Evidence Needed For A Successful Claim

Examples of evidence we might require for a medical negligence claim:

  • Medical records, including any surgeries, X-rays, scans (visits to gynaecologist, your  GP, nurse).
  • Maternity/handheld notes
  • A medical report.
  • Timeline of your appointments.
  • Witness details – If you have had a member of your family or a friend with you during the appointment.
  • Keep any prescriptions you have received.

Call our advisors today for a free, no-obligation consultation. If you are eligible, you could be connected to one of our No Win No Fee solicitors who can further advise you on gathering evidence to support your claim for misdiagnosed ectopic pregnancy compensation.

How Long Claims Can Take

There isn’t any set time frame for how long a medical negligence claim takes to move through the claims process. However, when estimating how long your claim will take to reach settlement, those responsible for doing so will consider:

  • Claim complexity.
  • Evidence strength and whether you have to gather more.
  • Whether the other party accepts or denies liability.
  • Negotiations. For example, if you are offered a settlement, but do not believe that this amount fully compensates you, you could negotiate for more.
  • Injury complexity and lifestyle impact.

Time Limit To Start A Claim

Medical negligence claims must be started within three years of the incident occurring or three years from the date of your knowledge (this is when you knew, or would have been expected to know that medical negligence occurred).

The limitation period is outlined in Limitation Act 1980. However, the Limitation Act allows for some exceptions to this time limit, such as for minors or those without the mental capacity to manage a claim on their own.

For more details on time limits when making a misdiagnosed ectopic pregnancy compensation claim, call our advisors today.

How Our Solicitors Can Help You

Our solicitors are extremely experienced, with extensive expertise in medical negligence claims.

They can help with:

  • Collecting evidence
  • Making appointments with independent medical experts
  • Negotiating with the defendant’s solicitors

They can do all this for you and more without taking any upfront or ongoing fees for their work. This is due to the fact that they work with their clients through something called a Conditional Fee Agreement (CFA), which is a kind of No Win No Fee arrangement.

What this means for you is:

  • Your solicitor won’t ask for an upfront payment for their work on your claim.
  • They also won’t take ongoing fees towards their services.
  • However, if you make a successful claim, then a small success fee will be deducted from the compensation awarded to you. This success fee is a legally capped percentage, which ensures that you receive the majority of your compensation.

If you feel you have suffered from a misdiagnosed ectopic pregnancy and would like to discuss making a claim, please call one of our advisors, as they are eager to assist you at this time.
