Time Limits For Making A Claim

Notably, you will have up to 3 years to bring forward your claim in as set out by the Limitation Act 1980. As such, the personal injury limitation period runs from the date of the accident.

Moreover, the following exceptions may apply:

  • If the claimant is a child, they will be required to wait until their 18th birthday to make a claim. From this date, they will have 3 years to claim.
  • If the claimant is lacking in mental capacity, the time limit will freeze for an indefinite period. If their mental capacity is regained, they will have 3 years to claim from this date.
