How Much Facial Injury Compensation Could I Get?

If your claim wins, various factors will determine how much facial injury compensation you may get. In the case of general damages, which provides compensation for an individual’s injuries, those factors might include whether there is any long-term disability or impact on quality of life.

Fractures of Jaws (ii)£21,920 to £37,210This is for serious jaw fractures with permanent consequences, like difficulty with eating or opening the mouth.
Fractures of Jaws (iii)£7,880 to £10,660Simple jaw fractures that require immobilisation, but where recovery is complete.

Facial Scarring

This table has suggestive compensation brackets for facial scarring.

Less Severe Facial Scarring£21,920 to £59,090Substantial facial disfigurement, with a psychological reaction that is significant.
Significant Facial Scarring£11,120 to £36,720Worst effects will be (or have been) reduced by plastic surgery, but claimant will have some cosmetic disability. The psychological reaction will not be considered great or will have diminished to relatively minor levels having been considerable at first.
Less Significant Facial Scarring£4,820 to £16,770Claimant may have a single scar or a number of very small ones. Cases involving 1 scar that may be camouflaged or otherwise and do not have a cosmetic blemish that is significant will likely attract the lowest end of the bracket.
Trivial Facial Scarring£2,080 to £4,310Any effect will only be minor.

How Much Compensation For The Psychological Impact Of Facial Injuries?

The specifics of your case will determine how much compensation you may receive for the psychological impact of facial injuries. You can see a selection of the JCG’s brackets for psychological injuries below.

Moderate Psychiatric Damage (c)£7,150 to £23,270Claimants may have had the kind of problems seen in above brackets, such as an effect on friendships, but there will be marked and a good prognosis.
Less Severe Psychiatric Damage (d)£1,880 to £7,150This award is determined by the length of time spent with the psychological disability and the extent that sleep and daily life were impacted.
Severe PTSD (a)£73,050 to £122,850There are permanent psychological effects that prevent claimants from working or at least functioning anywhere near pre-trauma levels. All aspects of life are badly affected.
Moderately Severe PTSD (b)£28,250 to £73,050Prognosis is better than above with professional help enabling some recovery. However, the PTSD is likely to cause significant foreseeable disability.
Moderate PTSD (c)£9,980 to £28,250Claimant will have largely recovered, and any ongoing effects are not grossly disabling.
Less Severe PTSD (d)£4,820 to £9,980A virtually complete recovery is made between 1 and 2 years, with only minor symptoms persisting.

Are Special Damages Awarded In Facial Injury Claims?

Yes, special damages are awarded in facial injury claims. This is the part of a claim that provides compensation for any financial losses you incurred as a result of your facial injury. Some examples include: 

  • Lost wages or work benefits for your time off work 
  • Payments for private corrective treatment, surgery, and dental work
  • Mental health services, such as counselling

What Accidents Could Lead To An Injured Face?

Any type of accident may cause a person to sustain a facial injury. Below you can see some examples of how these may occur and why they may lead to facial injury claims. 

Road Traffic Accidents

Under the Road Traffic Act 1988 and the Highway Code, all road users have a duty of care to all other road users, including cyclists and pedestrians. As such, they must use the roads safely and responsibly to avoid harming others. If a road user breaches this duty of care, causing your facial injuries, you may be entitled to compensation. 

  • Example: You are riding along a one-way street on a motorcycle. However, a distracted driver turns onto the street and collides with your bike, causing you to fall off. This leaves you with several injuries, including a cheekbone fracture.

Public Place Accidents

Anyone in control of a public place has a duty of care to take practicable steps to ensure visitors are reasonably safe. As such, they must comply with the Occupiers’ Liability Act 1957. If they fail to do so, causing your facial injury, you may be able to claim compensation.

  • Example: You are attending a firework display in your local park, organised by the local council. However, they failed to complete a safety inspection or place safe distancing barriers. Subsequently, several defective fireworks malfunction and explode near you, causing facial burns and scarring. 

Workplace Accidents

Under the Health and Safety at Work etc. Act 1974, all employers have a duty of care to their staff. This involves taking reasonable measures to ensure their employees’ health, safety, and well-being. If your injury results from a health and safety breach, you may have a case to make a workplace accident claim.

  • Example: Your employer asks you to use a saw to cut wood and knowingly provides defective protective goggles. As a result, shards of wood penetrated through to your eyes, leading to partial blindness.

Can I Claim For Facial Injuries Sustained From Assault?

If you were assaulted and sustained a facial injury, you may be entitled to compensation under a criminal injury claim. This would be done via the Criminal Injuries Compensation Authority, a government-funded executive agency. 

This organisation aims to compensate victims of violent crime who meet certain eligibility criteria. Although the perpetrator does not need to be arrested or convicted for you to claim, the CICA does require a crime to have been reported to the police. 

The Criminal Injuries Compensation Authority Scheme

The CICA uses the Criminal Injuries Compensation Authority Scheme 2012 to determine payouts for successful claims. This establishes a fixed tariff for various forms of physical and psychological injury. Additionally, certain financial losses can be claimed for, which are termed special expenses.

Time Limit For Starting A Facial Injury Claim

There is a 3-year time limit for starting a facial injury claim. This typically begins on the date you sustained your injury, so it is worth making a note of this. 

This time limit applies to the majority of personal injury claims under the Limitation Act 1980. However, there are exceptions when it may not apply if:

  • The claimant is a child, as anyone under 18 is not permitted to start a compensation claim themselves. In such circumstances, the time limit only begins when a minor turns 18th and ends on their 21st birthday. 
  • The claimant lacks mental capacity and is not able to go through the claims process independently. However, if they regain their mental ability, the time limit will restart on the date they obtained knowledge of this.  

If the time limit on a facial injury claim is paused, the claimant may still receive the compensation they deserve. However, a litigation friend would claim it on their behalf.
