Many common accidents can lead to a chest injury, including car collisions, faulty machinery, and tripping hazards.

Road Traffic Accidents

All road users have a duty of care to avoid causing injury to themselves and others. This duty further involves complying with the Highway Code and the Road Traffic Act 1988. A road traffic accident can result from a failure to abide by this duty of care.

  • Example: A motorist is using their phone and not paying attention to the road. They rear-end the car in front of them, leaving the other driver with a life-threatening hemothorax.

Accidents At Work

Every employer is required to take practicable steps that protect the welfare, health, and safety of their employees. This duty is set by the Health and Safety at Work etc. Act 1974, and could be met by providing safety training or appropriate personal protective equipment (PPE). 

A breach of this duty on the employer’s part may form the basis of a valid accident at work claim.

  • Example: Construction management neglects regular site inspections, leading to the ladders falling into a state of disrepair. One later breaks while being used, leading a builder to fall and suffer multiple chest fractures.

Public Liability Accidents

Those parties which are in charge of public places are known as occupiers, and have a duty of care under the Occupiers’ Liability Act 1957. This involves implementing practical measures to ensure all visitors are kept reasonably safe. A breach of this duty may lead to a public liability claim against the occupier.

  • Example: The owner of a shopping centre repeatedly delays arranging repairs to a faulty handrail on a poorly maintained staircase. This causes a customer to fall and sustain a serious sternum fracture.

What Is Needed When Making Chest Injury Claims?

When making chest injury claims, evidence is needed that shows how another party’s negligent actions directly led to harm. It is also essential to make sure that you start your chest injury claim within 3 years of the accident, as set by the Limitation Act 1980.
