Therefore, if you have sustained damage to your abdomen and you believe a third party is responsible, you may wish to learn more about abdominal injury claims.

Can I Claim Compensation For An Abdominal Injury?

Yes, you can claim compensation for an abdominal injury if you can prove that you were hurt due to the negligent actions of another.

Bluntly, you must be able to prove:

  1. You were owed a duty of care (this is a legal obligation relating to your health and safety)
  2. This duty was breached
  3. This breach of duty meant that you suffered an abdominal injury

In the following section, you will find a much more detailed breakdown of the types of duty of care you are owed in relation to different settings and spaces. Moreover, we discuss when an abdominal injury claim can be made in each of these different places.

Are you not quite sure whether you satisfy the above eligibility criteria? Don’t worry, a dedicated advisor can assess your eligibility for free over the phone today.

Common Causes Of Abdominal Injury Claims

Common causes of abdominal injury claims can range from a penetrating wound in a road traffic accident to blunt force trauma from a slip, trip or fall in a public space.

Take a look at some of the examples below in various settings:

Road Traffic Accidents

All road users owe one another a duty of care to use the roads responsibly to  keep everyone safe. It’s a legal requirement to follow the rules of the Highway Code and the Road Traffic Act 1988. Please find an example of when you could claim for road traffic accident below:

  • A driver is looking at their phone while driving and crashes into the back of another vehicle. This causes the driver in front to slam their abdomen into the steering wheel and fracture several of their lower ribs.

Public Place Accidents

When you are in a public place, the occupier (the party in control of that area) has a duty of care to take steps to ensure your reasonable safety, as outlined in the Occupiers’ Liability Act 1957. Please take a look at the example below:

  • A person is browsing in a library when a bookcase falls on them because the shelving unit is not secured to the wall. The individual is crushed beneath the bookcase and suffers internal bleeding and some organ damage.

Workplace Accidents

Your employer has a legal duty of care to take reasonable steps to ensure your safety, as per the Health and Safety at Work etc Act 1974. An example of an accident at work claim might be:

  • An employer has failed to provide regular maintenance for forklifts in their factory. The forklift malfunctions, throwing an employee, causing them to fall on a sharp object, which stabs them in the stomach.

Can I Claim For An Abdominal Injury Caused By Medical Negligence?

Yes, you can claim for an abdominal injury caused by medical negligence if you can prove that your medical professional provided you with negligent treatment, which resulted in you suffering avoidable or unnecessary harm.

All medical professionals owe a duty of care to any and all patients they agree to treat. This translates to providing a minimum standard of care. If a medical professional fails to provide this, they may have breached their duty of care towards their patient.

In order for your abdominal medical negligence claim to be valid, you must be able to prove the following:

  • A medical professional, such as a surgeon or a doctor, owed you a duty of care
  • They breached this duty of care
  • The breach resulted in you suffering a type of harm that is deemed avoidable or unnecessary

An example of when a medical negligence claim could be made might be:

  • The surgeon damages a patient’s abdominal wall whilst performing a hysterectomy surgery due to using improper techniques.

Another thing to bear in mind is that not every instance of harm will result from medical negligence. Specifically, patients can unfortunately suffer harm even when medical professionals provide the correct standard of care.

If you would like to talk about medical negligence claims in greater detail, our advisors are available 24/7 to answer any questions you may have.

What Abdominal Injuries Might Be Sustained?

What Compensation Could Be Awarded For An Injured Abdomen?

The compensation that could be awarded for an injured abdomen, for example, due to a traumatic injury to the digestive system, ranges from £8,060 to £75,550, according to the Judicial College Guidelines (JCG). However, your solicitor will take into account the whole picture, including things like the severity of injury, the presence of multiple injuries and whether you have incurred financial losses.

The JCG is a document that lists a wide range of injuries and their severities, along with suggested compensation brackets. As a result, solicitors will refer to this publication to assist them in calculating general damages compensation for their clients.

Specifically, general damages are designed to compensate the claimant for any pain and suffering they have experienced as a direct result of their injury. (This includes both the physical and the mental suffering.)

Compensation Guidelines

We have created a table below containing several JCG figures relating to abdominal injuries. The idea is that this will give you a clearer picture of what abdominal injury compensation could look like. With that being said, please note that the first figure has not been sourced from the JCG, and we also ask that you use the following table as a guideline only.

What Will I Need To Claim For Abdominal Injury Compensation?

To claim abdominal injury compensation, you will need to gather as much evidence as possible to support your claim, such as medical records and photographs.

Please take a look below at the various steps you could take after suffering an abdominal injury:

  1. Look After Yourself and Get Treatment: Your health should be your first priority, so we actively encourage you to visit the most appropriate medical setting for your abdominal injury, whether that’s A&E or your GP surgery. This also creates an official medical record that you can leverage as evidence in your claim.
  2. Collect As Much Evidence As Possible: You should collect as much proof as you can to validate your version of events regarding your claim. Strong evidence includes the contact details of witnesses, photographs of your injury and the accident scene, possible CCTV or dashcam footage, and vehicle registration and insurance details (if involved in a car accident).
  3. Report the Accident: Reporting the accident to your employer, a landowner, the police, or your insurer creates an official record of the incident, which further fortifies abdominal injury claims.
  4. Write the Important Things Down: You should keep a personal log of what you have experienced since sustaining your abdominal injury, including any pain and discomfort you have experienced on a day-to-day basis.
  5. Secure Professional Legal Help: Engaging a solicitor is important, given the complexity of the legal system. You deserve to have strong legal representation at your back while you focus on your recovery.
  6. Adhere to the Legal Time Limit: It’s better to claim sooner rather than later in order to keep within the legal time limit. We talk about the personal injury claims time limit in more detail in the following section.

How Long Do I Have To Bring An Abdominal Injury Claim?

You have 3 years from the date you got hurt or from the date of knowledge to bring an abdominal injury claim, as per the Limitation Act 1980. This is called the limitation period.

However, there are exceptions to this legal time limit. To find out more, please refer to our guide on the personal injury limitation period.

If you’d like to speak to an expert advisor on whether your abdominal injury claim falls within the limitation period, please call us for free today.
