What Is A Success Fee In A Compensation Claim?

A success fee in a compensation claim is the percentage of compensation paid to your solicitor for winning your case.

Prior to the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LAPSO), a personal injury solicitor could recover a success fee from the defendant. However, this is no longer the case.

Instead, at the end of a successful claim, a solicitor may deduct a set percentage of the compensation. The type of No Win No Fee agreement your solicitor works under will affect how much is charged as this fee.

How Much Will A Success Fee Cost Me?

A success fee will cost you nothing out of your pocket, as this fee is taken from your compensation following a successful claim. However, the amount you will pay as this success fee will be dependent on the type of No Win No Fee agreement your solicitor offers you.

Under the Damages-Based Agreements Regulations 2013 (DBA), the success fee is capped at 25% of the compensation awarded to you. This amount will always be charged, regardless of how much work the solicitor does on your case.

Under the Conditional Fee Agreements Order 2013 the success fee is also capped at 25%. However, a solicitor may charge you less than this based on the amount of work they expect they will need to do. However, this percentage will always be agreed upon before the claim starts.

Why Can Solicitors Take Up To 25%?

The reason why solicitors take up to 25% from your compensation for their success fee is that this is the legal maximum they can take.
The reason for the success fee is that it compensates the solicitor for the risk they took on. Since they only get paid if your claim succeeds, the success fee is designed to balance out the cases they lose, where they earn nothing.

Additionally, by having a legal cap in place for the amount a solicitor can charge as their success fee, this helps ensure that you, as the claimant, always receive the majority of your payout.

Do JF Law Always Take 25%?

Although this is the maximum they can charge as your success fee, they may not always charge you this. How much you will pay as your success fee will be pre-agreed upon with one of our solicitors before your claim starts.

Will I Have To Pay My Solicitors If My Claim Is Unsuccessful?

If your claim is unsuccessful, you will not need to pay your solicitor for their services if they are working on your claim on a No Win No Fee basis. You will also not need to pay your No Win No Fee solicitor for their services, prior to the claim starting and while it is underway.

Claimants may choose to take out After-the-Event (ATE) insurance to help meet expenses, such as the defendant’s legal costs in the event a case is lost. ATE insurance may also cover related costs, such as commissioning expert medical reports.

Yes, a success fee will be deducted from your compensation if your claim is successful. This deduction is made automatically by your solicitor before any compensation is passed on to you. This ensures that the process is simpler and more predictable for claimants.
